1. PURPOSE AND SCOPE

Placing an order implies full and unconditional acceptance of these Terms and Conditions.

2. PRODUCTS

The products offered for sale on the website are gift sets or gift certificates that can be used at L’Orangerie de Montargis, subject to the terms and conditions specified for each offer. The key details of each gift set—including its contents, price, validity period, and, if applicable, any restrictions on use—are listed on the website before the order is confirmed. The photographs, images, and descriptions appearing on the website are provided for illustrative purposes only and are not contractually binding, subject to the essential elements of the offer.

3. PRICE

The prices listed on the website are in euros and include all taxes (TTC). The applicable price is the one listed on the website at the time the order is placed. L’Orangerie de Montargis reserves the right to change its prices at any time; however, the price charged to the customer will be the price in effect on the day the order is confirmed.

4. ORDER

The customer selects the gift set(s) they wish to order, enters the required information, reviews the order details, and confirms the order. Before finalizing the order, the customer can review the order details and correct any errors. The sale is deemed to be concluded upon the customer’s confirmation of the order and our confirmation thereof, subject to actual receipt of payment. A confirmation email is sent to the customer at the address provided during checkout. L’Orangerie de Montargis reserves the right to refuse or cancel any order for legitimate reasons, including payment difficulties, suspected fraud, or obviously incorrect information.

5. TERMS OF DISCOUNT

Unless otherwise specified on the website, gift sets or gift certificates are sent to the customer in digital format (PDF) via email to the address provided at the time of order. The customer is responsible for ensuring the accuracy of the email address provided at the time of ordering. L’Orangerie de Montargis cannot be held liable for failure to receive the gift box or gift certificate due to a data entry error attributable to the customer. 6. TERMS OF USE FOR GIFT SETS

Gift certificates are valid for the period indicated on the website and/or on the gift certificate at the time of purchase. Unless otherwise stated, gift certificates are valid for one year from the date of purchase. They may be redeemed exclusively at L’Orangerie de Montargis, by prior reservation and subject to availability. Unless otherwise specified, gift certificates cannot be used during annual holidays, days when the venue is closed, special events, or on exclusion dates specified on the website or at the time of reservation. The recipient must present their gift certificate upon arrival. Gift certificates may be redeemed up to their face value or as specified for the service. Unless otherwise stated on the gift certificate, they are not exchangeable for cash, non-refundable, and cannot be split into multiple uses. L’Orangerie de Montargis shall not be held liable in the event of loss, theft, accidental deletion, or fraudulent use of the gift certificate.

7. PAYMENT

Payment is made online by credit card or any other payment method offered on the website at the time of ordering. The order is not definitively confirmed until the payment has been accepted by the bank or the relevant payment service provider. L’Orangerie de Montargis does not store the customer’s full banking information when payment is processed through a secure payment service provider.

8. RIGHT OF WITHDRAWAL

In accordance with the Consumer Code, the consumer generally has fourteen (14) days from the date the contract is concluded to exercise their right of withdrawal. However, by confirming their order and requesting immediate performance of the service—which consists of issuing and sending the gift certificate in digital format—before the expiration of the withdrawal period, the customer expressly acknowledges: – that they are requesting immediate performance of the contract; – that they waive their right of withdrawal upon full delivery of the gift certificate. Consequently, once the gift certificate has been issued and sent to the customer before the end of the statutory withdrawal period, the customer may no longer exercise their right of withdrawal.

9. LIABILITY

L’Orangerie de Montargis shall not be held liable for the non-performance or improper performance of the contract when such failure is attributable either to the customer, to an unforeseeable and insurmountable event caused by a third party not party to the contract, or to a force majeure event. In particular, L’Orangerie de Montargis shall not be held liable for any malfunction of the Internet, a temporary interruption of the website, a problem with electronic transmission, or any temporary unavailability beyond its control.

All elements of the website—whether visual, textual, audio, or technical—are protected by intellectual property law. Any reproduction, display, adaptation, or use, in whole or in part, of the entire website or any portion thereof without prior written authorization is prohibited.

13. GOVERNING LAW – DISPUTES

These Terms and Conditions are governed by French law. In the event of a dispute, and in the absence of a prior amicable resolution, the matter shall be brought before the competent French courts in accordance with general law.
