1. OBJECT AND SCOPE OF APPLICATION

2. PRODUCTS
The products offered for sale on the website are gift sets or gift vouchers that can be used at L’Orangerie de Montargis, according to the conditions specified on each offer. The essential characteristics of each gift set, its contents, its price, its validity period and, where applicable, any restrictions on use, are indicated on the website before the order is validated. The photographs, visuals and descriptions appearing on the website are for illustrative purposes only and have no contractual value, subject to the essential elements of the offer.
3. PRICE
The prices displayed on the website are expressed in euros, including all taxes (VAT). The price applicable is that displayed on the website at the time of ordering. L'Orangerie de Montargis reserves the right to change its prices at any time, however, the price invoiced to the customer will be the one in effect on the day the order is validated.
4. ORDER
The customer selects the gift set(es) they wish to order, fills in the requested information, checks the details of their order and submits it for validation. Before finalizing the order, the customer can check the details of their order and correct any errors. The sale is deemed concluded upon the customer’s validation of the order and confirmation thereof, subject to the actual payment of the price. A confirmation email is sent to the customer at the address provided during the order. Orangerie de Montargis reserves the right to reject or cancel any order in the event of legitimate reasons, including payment difficulties, suspected fraud or manifestly erroneous information.
5. REMITMENT METHODS
Unless otherwise specified on the website, gift sets or gift certificates are sent to the customer in digital format (PDF) by email to the address provided during the order. The customer is responsible for the accuracy of the email address provided during the order. In the event of non-receipt due to an input error attributable to the customer, L’Orangerie de Montargis cannot be held responsible. In the event of a receipt issue not attributable to the customer, the customer may contact L’Orangerie de Montargis at the address [email protected] or at 02 38 93 33 83.
6. CONDITIONS FOR USING GIFT BOXES
Gift sets are valid according to the duration indicated on the website and/or in the gift voucher at the time of purchase. Unless otherwise stated, gift sets are valid for one year from the date of purchase. They are exclusively available at L’Orangerie de Montargis, by prior reservation and subject to availability. Unless otherwise stated, gift sets are not available during annual holidays, closed days, special events, or the exclusion dates specified on the website or during booking. The recipient must present their gift voucher upon arrival. Gift sets are valid within the limits of their face value or according to the express service mentioned. Unless otherwise stated on the box, they are neither exchangeable for cash nor refundable, nor divisible into multiple uses. In the event of loss, theft, accidental deletion or fraudulent use of the gift voucher, L’Orangerie de Montargis will not be liable.
7. PAYMENT
Payment is made online by credit card or by any other payment method offered on the site at the time of ordering. The order is definitively validated only after acceptance of the payment by the relevant banking institution or payment provider. L'Orangerie de Montargis does not retain the customer’s complete bank details when payment is entrusted to a secure provider.
8. RIGHT OF WITHDRAWAL
In accordance with the Consumer Code, the consumer customer has, in principle, fourteen (14) days to exercise their right of withdrawal from the conclusion of the contract. However, by validating their order and requesting the immediate execution of the service consisting in the issuance and sending of the digital gift voucher before the expiration of the withdrawal period, the customer expressly acknowledges: – requesting the immediate execution of the contract; – waiving their right of withdrawal once the complete delivery of the gift voucher has been provided. Consequently, once the gift voucher has been issued and transmitted to the customer before the end of the statutory withdrawal period, the customer will no longer be able to exercise their right of withdrawal.
9. RESPONSIBILITY
L'Orangerie de Montargis cannot be held responsible for the non-performance or improper performance of the contract when it is attributable to the customer, to an unforeseeable and insurmountable fact of a third party to the contract, or to a case of force majeure. L'Orangerie de Montargis cannot, in particular, be held responsible for a malfunction of the Internet network, a temporary interruption of the site, an electronic delivery problem, or a temporary unavailability independent of its will.

12. INTELLECTUAL PROPERTY
All elements of the site, whether visual, textual, audio or technical, are protected by intellectual property law. Any reproduction, representation, adaptation or exploitation, total or partial, of all or part of the site without prior written permission is prohibited.
13. APPLICABLE LAW – LITIGES
These GTC are subject to French law.
In the event of a dispute, the customer first submits a written complaint to L’Orangerie de Montargis ([email protected]). In the absence of an amicable agreement, the consumer customer may, free of charge, approach the consumer mediator responsible for L’Orangerie de Montargis, AVENIR CONSO, within one year from the date of their written complaint:

The customer can also consult the European Consumer Centre France: www.europe-consommateurs.eu.
In the absence of an amicable resolution, the competent French courts will be seized under the conditions of ordinary law.
